  1. SKULT AS DATA CONTROLLER
    KOL INVEST, SRL, with its registered office at Avenue d’Orbaix 23/A Boîte 4, 1180 Uccle and registered with the Crossroads Bank for Enterprises under number 0776.362.165, for itself, a company it represents, or a company to be incorporated (hereinafter referred to as “Skult”), confirms that it is responsible for processing your data. Any changes will be notified by email, giving you a thirty-day period to accept or refuse the new terms regarding your data. In the absence of any objection from you, we will consider that you have accepted the new data processing policy.

    As part of its activities, Skult records the following data:

    • names;
    • first name;
    • gender / gender identity;
    • VAT number;
    • language;
    • date of birth;
    • vehicle registration number for parking access;
    • services consumed;
    • IP address;
    • email address;
    • address;
    • phone number;
    • financial data (bank account number).
  3. DATA COLLECTION
    We collect your personal data when you register on our site, subscribe to our newsletter, make a reservation, contact us, use our online chat, participate in contests, or provide feedback on our services.
  4. PURPOSES AND LEGAL BASES
    Skult processes personal data in the following situations:

    • Contractual Performance (Article 6.1.b of the GDPR): To implement and manage the services or products you have subscribed to, we require your contact details (name, address, etc.), payment information, and potentially other relevant data.
    • Administrative Management (Article 6.1.b of the GDPR): To provide you with our services optimally, we use your data for routine operations such as invoicing, account management, and resolving any issues.
    • Personalized Communication (Article 6.1.a of the GDPR): With your explicit consent, we send you personalized information (newsletters, promotional offers) via email or other channels. We may also use analytics tools such as Facebook Pixel and Google Analytics to improve our communications.
    • Debt Collection (Article 6.1.b of the GDPR): In the event of non-payment, we may transmit your data to a third party specializing in debt collection. Personal data is retained for a maximum of 10 years after the end of the business relationship. For personalized communications, you can withdraw your consent at any time via the unsubscribe button in the email received. Data will be retained for specific periods, defined according to their purposes. For example:
      • For the entire duration of the contract’s execution;
      • 8 years after contract execution for debt collection purposes;
      • 7 years after contract execution for administrative management;
      • 10 years for accounting data. For other processing purposes, the retention period will be determined based on the nature of the data and the objectives pursued. In any case, it will not exceed the period strictly necessary to achieve the stated purposes.
  5. DATA RETENTION
    Your personal data is stored in a secure environment, protected against unauthorized access. Only authorized personnel can access it, within the scope of their duties.
  6. SURVEILLANCE CAMERA
    Surveillance cameras installed on the Skult site aim to prevent theft and ensure the safety of employees and clients. These devices operate 24/7. Video recordings are kept for a maximum of 30 days and are strictly for internal use for security reasons. Access to images is limited to authorized personnel only. Skult complies with the obligations mentioned in the law of 21 March 2007 regulating the installation and use of surveillance cameras.
  7. SPECIFIC RULES FOR MINORS
    In accordance with data protection regulations, parental consent is required for any processing of personal data of a minor under 13 years of age.
  8. CLIENT RIGHTS
    As a client, you have the following rights:

    • Right to access your personal data;
    • Right to rectification of your personal data;
    • Right to erasure of your personal data;
    • Right to data portability of your personal data;

  9. DATA TRANSMISSION TO THIRD PARTIES
    Your data is processed by our teams and technical partners (booking software) to provide you with our services. We may also be required to transmit them to competent authorities as part of our legal obligations. In principle, your data is not transferred outside the European Union. However, when using the STRIPE payment tool, it is possible that data may be transferred and stored outside the European Union. As stated in its privacy policy (https://stripe.com/privacy-shield-policy/), STRIPE complies with the EU-U.S. DPF concluded between the European Union and the United States. We do not sell your data to non-partner third parties or Skult subcontractors. In the event of a transfer of our business, we would inform you of any transfer of your data.
